These Terms & Conditions apply to purchases made through RockOnDigital.com.

Rock on Digital Ltd provides physical products, digital products and other entertainment-related content through this website. By placing an order with us, you agree to these Terms & Conditions.

Nothing in these Terms & Conditions affects your statutory rights as a consumer.

1. About Us

RockOnDigital.com is operated by Rock on Digital Ltd, a company based in the United Kingdom.

References in these Terms to “we”, “us” and “our” mean Rock on Digital Ltd. References to “you” or “the customer” mean the person placing an order through the website.

2. Orders

When you place an order, you are offering to purchase the products or services shown in your order at the stated price.

An order is accepted when we confirm that we have accepted and are processing your order.

We reserve the right to refuse or cancel an order where there has been an obvious pricing or product-description error, where a product is unavailable, where payment cannot be authorised, or where we reasonably suspect fraudulent or unauthorised activity.

If we cancel an order after payment has been taken, we will refund the amount paid.

3. Prices and Payment

Prices are displayed in the currency shown on the website at the time of purchase.

Delivery charges, where applicable, are shown during checkout.

For orders being delivered outside the United Kingdom, additional local taxes, customs duties, import charges or handling fees may become payable when the shipment enters the destination country.

4. International Orders, Customs & Import Charges

Customers ordering physical products for delivery outside the United Kingdom are responsible for ensuring that the products may legally be imported into their destination country.

Any import VAT, sales taxes, customs duties, tariffs or other import charges imposed by the destination country are the responsibility of the recipient unless we expressly state otherwise at the time of purchase.

Where our chosen postal or delivery service charges us a mandatory handling or processing fee associated with an international shipment, we may pay that fee as part of arranging delivery.

The recipient remains responsible for taxes and duties assessed by the destination country’s customs or tax authorities.

We have no control over the amount of these charges and cannot predict what a particular country may charge.

If a recipient refuses to pay applicable import taxes or duties and the shipment is consequently refused, abandoned or returned to us, any refund will be dealt with in accordance with the Refunds and Returns section below and applicable consumer law.

5. Delivery of Physical Products

We aim to dispatch physical products within the timescale stated on the website or order confirmation.

International delivery times are estimates and may be affected by customs processing, postal delays or circumstances outside our reasonable control.

Please ensure that the delivery address supplied when ordering is complete and correct. We cannot accept responsibility for delivery problems resulting from incorrect information supplied by the customer, except where required by law.

Risk in physical goods passes to you when the goods are delivered to you or to a person you have nominated to receive them, subject to applicable consumer law.

6. DVDs, Blu-rays and Other Physical Media

Some products sold through RockOnDigital.com may be limited editions, collector’s editions or products produced in limited quantities.

Product photographs and packaging illustrations are provided for guidance. Minor differences in packaging, artwork or presentation may occur unless a particular feature is expressly stated to form part of the product.

Please check any stated format, region or compatibility information before ordering.

7. Digital Products, Downloads and Streaming Content

Digital products may include downloadable films, programmes, books, artwork, files or access to streamed content.

Where digital content is supplied immediately following purchase, you will be asked, where required by law, to consent to supply beginning during the statutory cancellation period and to acknowledge that you will lose your right to cancel once supply of the digital content has begun.

Unless otherwise stated, purchasing digital content gives you a licence for your own personal, non-commercial use. It does not transfer copyright or other intellectual-property rights to you.

Digital content must not be copied, redistributed, resold, uploaded, broadcast or made publicly available except where expressly permitted by us or by law.

8. Refunds, Returns & Cancellations

Physical products

For most physical products purchased online, UK consumers have the right to tell us that they wish to cancel within 14 days after receiving the goods, without having to provide a reason. After notifying us, you normally have a further 14 days in which to return the goods.

Unless the goods are faulty or damaged, the customer is responsible for the cost of returning them.

Goods should be returned in reasonable condition. We may make a deduction from a refund where permitted by law if the value of the goods has been reduced as a result of handling beyond what would reasonably be necessary to inspect them.

Sealed DVDs and Blu-rays

The statutory change-of-mind cancellation right does not normally apply to sealed audio, video or computer software products once the seal has been broken.

Accordingly, DVDs, Blu-rays and similar sealed media that have been opened or unsealed cannot normally be returned simply because the customer has changed their mind.

This does not affect your rights where the product is faulty or damaged.

Digital products and streaming

Where you have expressly agreed that digital content may be supplied immediately and acknowledged that your cancellation right will be lost when supply begins, you will normally no longer have a change-of-mind right to cancel once the download, stream or other supply of the digital content has begun.

This does not affect your statutory rights if digital content is faulty or does not conform to the contract.

Faulty, damaged or incorrect products

If you receive a product that is faulty, damaged, not as described or different from the product ordered, please contact us as soon as reasonably possible.

Depending on the circumstances and your statutory rights, we may offer a replacement, repair, refund or other appropriate remedy. UK consumer law provides specific protections for faulty physical goods and digital content.

Refund payments

Where a refund is due, it will normally be made using the original payment method.

For eligible cancelled physical orders, refunds will be processed within the time required by applicable consumer law. For UK consumers this will generally be within 14 days of our receiving the returned goods, or receiving evidence that they have been sent back, where applicable.

Original standard delivery charges will be refunded where required by law. Additional amounts paid for an enhanced or expedited delivery service need not necessarily be refunded beyond the cost of our standard delivery option.

9. International Returns

If you are returning a product from outside the United Kingdom, please contact us before sending it.

Unless the product is faulty or damaged, you are normally responsible for return postage and any associated costs.

Please clearly identify returned goods as a return on any customs documentation where appropriate. We cannot accept responsibility for customs charges arising because a return has been incorrectly declared by the sender.

Where an international shipment is returned to us because the recipient refused to pay applicable local import taxes or duties, we may deduct costs that we are legally entitled to recover before issuing any refund. Nothing in this clause limits any mandatory consumer rights that apply to the transaction.

10. Lost or Undelivered Orders

If an order has not arrived within a reasonable period, please contact us.

International delivery can take longer because of customs clearance and local postal services. An order should not automatically be regarded as lost simply because an estimated delivery date has passed.

Where a shipment is confirmed as lost, we will provide the remedy required by applicable consumer law and may offer a replacement or refund as appropriate.

11. Intellectual Property

Unless otherwise stated, the films, programmes, artwork, text, graphics, branding and other content available through RockOnDigital.com are owned by or licensed to Rock on Digital Ltd.

Purchasing a product does not grant any right to reproduce, distribute, publicly exhibit, broadcast, commercially exploit or otherwise use that content beyond the rights expressly supplied with the product.

12. Website Availability

We aim to keep RockOnDigital.com available and functioning correctly but cannot guarantee uninterrupted access.

We may temporarily suspend or change parts of the website for maintenance, security, technical or operational reasons.

13. Liability

Nothing in these Terms excludes or restricts liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer-protection law.

We are not responsible for losses that were not reasonably foreseeable when the contract was entered into or for losses arising from circumstances outside our reasonable control, subject always to your statutory rights.

We do not exclude responsibility for supplying goods, services or digital content that do not meet the standards required by applicable consumer law.

14. Privacy

Personal information supplied when using RockOnDigital.com is handled in accordance with our Privacy Policy and applicable data-protection legislation.

Information may be supplied to payment providers, postal operators, couriers and customs authorities where necessary to process payment, fulfil an order or deliver a shipment.

15. Changes to These Terms

We may update these Terms & Conditions from time to time.

The terms applicable to an order will normally be those published on the website when that order was placed, except where a change is required by law.

16. Governing Law

These Terms & Conditions are governed by the laws of England and Wales, subject to any mandatory consumer rights that apply in the country where you live.

Nothing in these Terms deprives a consumer of protections that cannot legally be excluded.
